Entry Visa Worries

I am positive that this is a topic that will have been talked about before, and I am soring for boring frequent readers with a repeated theme. I had a quick scan through though and couldn´t find anything directly applicable.

In October 2013, I entered the country on a regular 90 day stamp and never left since. That is to say that I have been illegal for ten months now. Recently I´ve decided it would be a good idea to get a DNI etc but think it´s probably best to start the process with an up to date entry visa. However, I´m a bit nervous about leaving. If it were a week, or a month that I had overstayed I wouldn´t really be bothered but I am nearly a year now and that makes it quite apparent that I am living and working here.

Does anybody have any experience with a similar situation? Will I be allowed back in? Should I "lose my passport" and go through the process of getting a new one to start afresh....would that even work?

Hopefully somebody can put my mind to rest a bit and take internet based responsibility for my incarceration if things go tits up

Do you qualify for a visa? If so I would get all my paperwork in order, to file for one, before I left the country and then carry it with you as your travel as proof that you are going to be filing for your visa.
 
Do you need to leave the country? If not, don't.
Do you qualify for some type of residency? If so, begin the process. Your current status does not matter.

If you don't qualify for residency and you don't need to leave the country and plan to live here indefinitely, you may try applying for citizenship. (I believe after 2 years?)

I would not try to "renew" the stamp with an in and out trip - that could be risky. Getting a new passport won't help you either since they'll want to know when you last entered the country and could potentially cause you more issues and expense.

No, no, no and no!!!!!!!
Apply for your DNI just like that. You are not legal if you renew your I-94, you are still a fake tourist. But if you leave the country they can reject you at the border.
 
Thanks all. The answer is that I don´t need to leave the country so I am going to let the next chapter unravel intself without leaving and running the risk of having to make the phonecall to my girlfriend telling her I am not coming home. The beurocracy scares me and it has been easy to sit under a rock and ignore the situation but now the time has come to act.

The minute you gather your documents, you´ll walk away from Retiro with your Residency in your pocket, .. in less than 2 hours .
Hardly any bureaucracy to mention.
At Retiro you´ll feel they are there to help you, ... They are not there to find out what is wrong with you !!!!
Just give them something to work with ...
It´s NOT the horror story it´s made out to be (I found out for myself .. after 9 years).

Citizenship ?, ... no idea how that goes.
No one on this forum ever outlined a clear case.

I hope you´re right. The woman at the little passport/dni stand in Abasto told me numerous times that I´m illegal and that I will be a prisoner soon. Her advice wasn´t overly helpful, but she seemed more interested in the hamburgers in front of her.
