Long term apartment/house rentals in Argentina vs. aborad

Hello,

A topic I have not seen much discussion on here are the radical differences between renter responsibilities as they pertain to long term residential rentals here, which are 2 year rentals.

For example, while structural issues are the responsibility of the owner, wear and tear issues are typically the resposnibility of the renter.

Specific examples:

Water heater: It is understood that it is the renter's responsibility to do proper periodic maintenance to make sure it continues to operate properly.

A front door that is made of wood: It is understood that it is the renters responsibility to keep it protected with periodic chemicals to counter-act the effects of the elements.

Examples like these, unless specifically addressed in advance, fall under the legal phrase of "the property must be returned to the owner in the same state as it was originally delivered to the renter.

So, on top of the monthly rent amount you must budget, make sure you understand specifically what amounts you must budget to keep the property up to snuff during the 2-year rental.

You are supposed to leave the rented property in the exact same state as it was on the day you rented it.

For that reason you should always have this exception in the contract: "Se exime al LOCATARIO de hacerse cargo de las reparaciones por artefactos antiguos o frágiles debiendo el LOCADOR asumir el costo de las reparaciones por vejez de los mismos." - the owner pays for repair of old and fragile artefacts/equipment.

Also "Se acompañan planilla anexa con detalle y fotos del estado de entrega del inmueble, las que forman parte del presente instrumento." - a complete list of even the smallest fault accompanied by photos of all floors, walls, doors, windows, wardrobes, lamps, and in general anything in the house or apartment, signed and included as part of the contract. I have 96 photos of details, signed by the owner.
