Hi all,

Just wanted to ask if anyone knows how wills and testaments work in Argentina or if anyone recommends any lawyers I could talk to?

My girlfriend has a grandmother who wants everything she owns to go to my girlfriend once she passes away. I heard that because of Argentine law the inheritance will go to my girlfriend's mother instead and my girlfriend is worried her mother's partner will try and acquire the inheritance.

I believe that the inheritance laws in Argentina are much better and fairer than the USA or Australia . It is only fair that the will should go to the next of kin first and only 20% of the total inheritance can be given to other family members or friends.

In Australia I knew of cases that old people were manipulated by conmen to obtain their estate .This is highly unfair as the only rightful heirs should be family . Argentina is much more advanced in many areas and this is one that I applaud them on.

You can't do that by law, even if you have a will here, and a will in the US has no jurisdiction here. We have the same problem: we want to decide who gets our money, not the govt. Our family members don't need the money, but friends and charitable organizations do.
 
To create a will, you don't need to look for a lawyer but an "escribano". The grandmother may allocate a percentage of her assets to whoever she wishes through a will. There were some changes to the "Codigo civil argentino" and the laws are stated there.
The grandmother may, if she wishes, donate her properties to whoever she wants through a "donación con usufructo" meaning that she donates her properties and may use them while she lives but as soon as she dies, the properties belong to the person she chose. For this procedure, also an "escribano" is needed; not a lawyer. This "donación con usufructo" is a very common procedure in Argentina.
 
If you own property in Argentina, you know a lawyer/escribano who can prepare your testamento.
 
If you are married your spouse inherits the property. See a specialist in la Ley de Sucesión.
