My girlfriend is born in Egypt and solely holds an Egyptian passport.

She moved with her family to Argentina when she was 10, and received a permanent residency after some time.

At 19 she left to go back to Egypt, and lived in between Egypt and Spain.

Now, 4 years later she is back in Argentina. We got through passport control without any issues (as permanent residency could be revoked after 2 years of not returning).

She wants to apply for the citizenship now, and was today told by the people working at the center that it is completely up to a judge whether she gets it granted or not, as she was 4 years outside of the country.

——-

My question:

What experiences do you have with this? Have any of you heard of anyone who applied for citizenship on the premise of years they lived in the country in the past? Is it a likely scenario that the judge denies it? She lived here from 10-19 and is well integrated.

Thanks! 🙏

The granting of citizenship for people not born inside Argentina or born to at least one native born Argentine parent is ALWAYS up to a judge as the naturalization process is a judicial and not an administrative process. If she already has permanent residency and is now actually residing in Argentina (judge will request entry/exit records directly from Migraciones) then the citizenship judicial process is relatively straightforward. The citizenship may not be granted, however, until she has actually been residing inside Argentina again for at least two years.
