Might be moving back to UK temporarily but don't want to lose residency in Argentina. Suggestions?

I've been offered a place on a postgraduate course in the UK which would be 15 months long (so I'd finish in December 2026). Currently I live in Argentina on a work visa and this is my second year here. In October I'll have to renew for another year. As far as I'm aware, even if I renew in October, If I leave the country for over 6 months I'll lose my residency anyway. Does anyone have any suggestions of what to do? Part of me thinks there's a chance I won't lose it but I feel like things have become more strict since Milei became president.

To renew it in October, you will need to still have the employment that entitles you to the residency. How will you retain the employment contract here if you go to the UK for 18 months? That seems to be the first hurdle, not the new arrangements in the DNU.

Thanks for your answer!

I've been looking at maybe continuing to work from the UK with the company I currently work for (I work partly remotely), that way I'd technically still be working out of Argentina.

The Ley 25.871 says that 6 months is the maximum amount of time you can be outside of Argentina with only temporary residency. I'm wondering whether that's 6 months in total or 6 continuous months (if it's the latter, I can make several short trips during the year to come back). Obviously this is something I should look over with a lawyer, but I was wondering if anyone had any experience/knowledge first.

I believe it is 183 days over the 365 days from the date of issue of the disposición.

The problem you may face is that when you lodge the application for another 12 months in October 2025 (and presumably again in October 2026) you must be in Argentina. And still be here when they assess it. If they see you as not in the country when it comes across the assessor's desk, she or he will reject it, I understand. And you have no control over how long it takes to get to that desk. It could be weeks and weeks hanging around here.

(I think it's going to be quite hard to do this.)

You mean to say that it's at least 183 days in total that need to be spent in Argentina? Or is it that you can't spend over 183 days in a row out of the country?

I see what you mean. You don't happen to know any good immigration lawyers do you?

It's a little unclear the way this week's DNU was worded, but it looks like, in theory at least, it's both; you must spend at least 183 days in Argentina and if you try to enter on the 183rd day of a consecutive spell of 183 days outside the country you may find your residency has been canceled.

After 2 years you can file for citizenship.

I was literally just looking at this. It mentions that you need to have 2 years or residency "ininterrumpida". Does this mean you can't have left the country at all in two years?

Thanks Alby, I hadn't seen the DNU but I'll have a look now.

I thought your question was prompted by the DNU. It has thrown the cat among the pigeons and there is plenty of activity on this board as a result in the last there or four days. Have a look around.

It talks about temporary residency getting cancelled after an absense of six months. But that doesnt seem any different to the prevailing situation. It just says the same thing a different way. I doubt even an immigration lawyer will yet be able to say how the DNU in this particular respect will be applied in practice. It may not make any practícal difference to what has gone before.

The bottom line is most likely that you need to spend at least 183 days here in a 365 day span to not either (i) lose your residency during the 365 days when presenting yourself at the Migraciones gate on entry with 184 days now outside the country, or (II) have to start from zero at the 365 day mark when you try to renew.
