Hi everyone, I thought this write up might be useful for those of you who are irregular as it seemed like a daunting process, however, my experience was the exact opposite.
I had an overstay of almost 2 years and I was very worried given the recent updates in the law and migraciones raids… however, I finally bit the bullet and applied through radex using family reunification as my basis for residency. I was given a meeting once I uploaded the documents and paid my fees.
I was so nervous given everything I’ve heard, but when I got there it was super straight forward! I showed the turno confirmation at the door, went to the reception and got directed to the right area. I was seen within 20 minutes. They didn’t mention my overstay at all! I gave my finger prints, a photograph, marriage certificate, criminal record, Cert of domicile, a sworn declaration on my lack of criminal record and residency history for the last 3 years and that was it.
They gave me a document explaining where I could get my precaria and said it would take 24 hours. It arrived first thing the next morning. For anyone out there still worried, I recommend doing this if you have a clear pathway towards one of the categories. Up to this stage, I think a lawyer would be largely unnecessary but my case isn’t complex (just my personal opinion, not formal advice). I haven’t received any intimations yet and hopefully I won’t.
I will update here as things progress and I’m happy to answer any questions
