Immigration Attorney

Can anyone recommend a full service immigration attorney in Buenos Aires? Someone that is reasonably priced, speaks English, and would be able to handle everything needed to settle down in the country, including handling the paperwork necessary for the Pensionado visa, and getting a DNI/driver's license.

In lieu of spending thousands of dollars, you can apply for citizenship yourself. If you have an Argentine friend, I imagine that he / she would be happy to help; even if such help is limited to directing you where to execute the requisite documents. People are nice here and are willing to help foreigners. Yes, it's tedious process but it's not a complex one. The necessary documents are clearly defined online. It's just a matter of having the patience and perseverance.

The biggest chores are the apostilled FBI report and apostilled income verification letters; which also must be be oficially translated with the translation itself then being legalized. Nobody asked me about depositing 5x the minimum salary each month. They just wanted to verify receipt of 5x the minimum salary each month.

Once you do it you will be proud of yourself for having saved thousands. Granted, if you have a criminal history, immigration violations or insufficient income, that is another story and you'd likely need an attorney. Good luck.

Even I have been suggested the same for over a decade, today is not possible anymore. For applying at Court you need a declaration of unconstitutionality and the new procedure under the DNM is draconian.

Are there real cases that were able to have the unconstitutionality of that DNM confirmed with further process of citizenship as it used to be ?

I wonder if individual federal judges actually have the power, on a case by case basis, to declare the recent decree unconstitutional and thereby have the authority to ajudicate an application for citizenship.

Perhaps they do, but I believe that the decree of 2017 was only declared unconstitutional by the Supreme Gourt and that ended the DMV's first "takeover" of the citizenship process. I don't know if individual federal judges were ever unable to accept citizenship cases before the Suprema Cout's decision. Either way, I'm confident.that efforts are already well underway to achieve a similar fate for the decree of 2025.

Yes they do. SC didn’t decide in DNU 70/2017, Chamber of Appeals did. There were over 120 declarations of unconstitutionality. However, it is too soon, normally are not the judges of the first hierarchy who declare it.

Thanks for making that clear. If I understand correctly, it's the Argentine Constitution that gives federal judges only, and not migraciones, the power to "grant" citizenship. Is there actually any mention of "migraciones" in the Argentine Constitution or was migraciones a later creation of the other branches of the government?

Sure, there are many clauses at the Constitution that bans the existence of the DNM.
