By the same argument, if you own a construction company, you should be able to expose your employees to asbestos dust, because they're obviously your private property just the same.
The overwhelming winner in smoking restrictions in bars and restaurants is occupational health and safety. These people spend every single work day breathing in a carcinogen so you can exercise your "right" in a "private" restaurant or bar.
