It doesn't really work that way. Nobody owns their cell phone # and therefore it cannot be sold privately. In other words, somebody can sell you a sim but the original owner will still be stuck paying for it as if it was their phone. Should you fail to pay the service fees, the phone company can pursue the original owner.
