For a start you can calculate what you should get. Might be that your employer will give you offer, of course minimum is to say that you have to consult your lawyer before signing anything. That is usually quite enough for them to propose something serious. Friends that were in similar position took the money and didn't bother with lawsuit, because they were getting enough in their opinion. If you don't really hate the guy, you just take decent amount instead to invent stories of harassment...

But yes, for 2 years you should get some money, my friend got 6 salaries for less than 2 years,first offer...
 
Again, my hunch is that the OP is being played for a sucker on account of being foreign. I think as little as one carta documento will fix things up substantially and quickly.

Even if they don't renew/are letting you go, yes they must still pay the legal severance. For two years of employment, you are due 2 months. Plus they must give you 30 days notice (or another 30 days of salary in lieu of giving this notice). And of course the proportional earning of your aguinaldo and vacation.

Before you get too worried - they very well may be waiting for their permission to employee foreigners to be renewed. Every company has to renew that annually and until that is done, they can't renew your contract. So don't get too stressed.

They are talking about liquidacion final, so that might imply they will be paying indemnification, holidays, aguinaldo, 30 day notice, etc. If that is true on Monday you are set and there is nothing to claim. Unless they have not been paying all taxes and contributions. However it is a legal requisite that they send you a telegramm. If they fail to do so, you are not formally fired. In any case, go talk to a lawyer just so you know where you are standing.
 
What is sure is, that he should get at least 3 if not more salaries, which in the first post he didn't know. As far as I know, final is, when you agree, even if there is final liquidation.

More important is, what he can do about his status, since this is his primary concern obviously. How long can he stay, what he should do...
