I always thought the only way to join the PROLETARIAN CLASS was if another PROLETARIAN bit you. But apparently, having an Argentine child works too. You live and you learn.
 
Hello Everyone. I have read the entire thread and I am still confused.
Hopefully I can get some input from the wise members of this forum :)

So my story is the following:

I entered with my wife and my 3 kids January 1st on a 90 day tourist visa and we extended it without problems for another 90 days.
We are from Germany. Now we have planned to do a visa run to Uruguay and just come back and repeat the cycle + extension.
I work remotely so I do NOT work in the country without license or anything.I get my money via WU.
Now we found a private school for the kids which would start August 1st and we even found a nice house to rent nearby.
We also planned to have another child and over that route find our path to permanent residency & later citizenship.Not leaving the country for 2 years then is no problem at all.

But with the new rules we are now super scared that we will be denied re-entry now and I am seriously considering overstaying for now until the child is born.

We have health insurance, I have no criminal record. I am a cybersecurity & devops specialist and I am sure I will be able to find a local job or start a company as soon as we have an DNI.

My current monthly income is around 5k usd which is enough to make sure we are not having any problems for the foreseeable future.

So what do is the general recommendation? Overstay and lawyer up?
I really do not want to run the risk of being denied entry..we have all our belongings here in that new house..it is not much but would be an absurd hassle...

Yes, I amaware that the overstay time would not count towards any residency time towards citizenship.
That's no problem. We fell in love with this weird country and we can wait anew 2 years or longer whenever the real countdown starts.

As someone who is currently overstaying, but already in the process of applying for the Unión Civil Convivencial with my partner, and subsequently permanent residency, it’s definitely a bit disconcerting. And of course it has come at the worst possible time!

I’m not sure if this now is, or will, be a possibility after reading the following:

“Los requisitos para acceder a la residencia permanente se reforzarán aún más. Esta se dará automáticamente solo hijos de argentinos. Los padres pasarán a encuadrarse en el régimen de residencia temporaria. Si luego acreditan arraigo, medios económicos suficientes (eso se determinará con exactitud en la reglamentación) y antecedentes penales limpios, están admitidos a ser residentes permanentes.”

I will certainly try nonetheless, and hope that (at the very least) I’m granted temporary residence and can satisfy any future requirements for permanent residence.

Hopefully things become clearer, and aren’t as bad as I fear.

Residency and citizenship for poors (family and 2 years of address) are over in DNU 366/2025. I suggest to apply for citizenship before you get a deportation order.

A "visa run" may be successful, but it will not make you eligible for an additional 90 day extension at the office of migraciones.

The 90 day visa you received on January 1st can only be extended once at the office of migraciones. Technically, you would have to leave the country for six months in order to legally repeat the cycle of getting a new 90 day entry permit and then a 90 day extension.

But with the new rules we are now super scared that we will be denied re-entry now and I am seriously considering overstaying for now until the child is born.

Meanwhile, I suggest that you find out if your three children will also be eligible for citizenship after you and their mother have it.

If that's what you decide to do, be sure to ask the lawyer in advance what to do if migraciones issues a deportation order, especially if they have your current address.

So, just don't leave on a completely pointless visa run that does not give you legal status with migraines. Even though the border official might still have the option to allow you to reenter, they may also have the option to ban your reentry for five years.

I am no lawywr but I would not do the visa run. Instead enroll in a recognized Spanish course and file for legal temp residency. Studrnt visas. Enfoll kids in school and apply for theirs and youur spouse as well. After 2 years or when baby is born apply for citizenship or perm residency.
