Yes, it's true, if you want to move even to Bariloche or something, the father can prevent this as it can be seen as impeding his rights to presence in the child's life.

Unfortunately when separations get very ugly a lot of people will use these laws not because they really want to be able to see their child, but because they want to make their exes' life miserable.
 
Obviously this is extremely sticky as everyone has explained. My advice would be to make up with your boyfriend, tell him you want to start over together in the States and that everything will be easier there. All three of you go there together on vacation to see if you like it, to meet the family, whatever.... and then when you get there maybe things will work out and you can start his visa process, or maybe they wont and he can decide to come home by himself - end of story.

This is true and there have been some recent cases where the mother and child were deported from the US back Argentinastan. So the highly abusive sperm donor could have easier access for beating the mother black and blue. She's still here 3 years later.

A restriction order is easily enforced even for people without resources. My associated works for the free legal service of UBA and they do this all the time.

There are 2 law regarding family protection:

1) law against family violence. The statement about violence is enough for a 90 days restriction order while the judge order psicology studies about the relationship. The judge also stablishes alimony. If he doesn t respect the judgement, he can be jailed.

2) criminal law against to avoid contact of children with one of his parents. The judge restablishes a visit regime immediately. It is a crime to abduct the children.

Argentina signed the international treaty about child s rights and the whole systems is ruled by the "superior interest/benefit of the child. The public defender of children is always there and he can decide over you.
