Media Law

Ed / Matias - I'll bet you all the beer you can drink that no new cable operator carries the TN news channel.

FpV / Campora are not socialist/anti-private business, not at all, they are very pro private business as long as that private business is on their side or on the team so to speak. There is a good article on the bubblear.com about Kircher Capitalism.

In the same way that private companies aligned to the govt sit in wait to sweep up if they can get rid of LAN, there will no doubt be cable entrepreneurs lined up to benefit.

Private business will fill that gap, but it will be team Campora private business. That's the trouble I have with all this, clientele capitalism will partner public propaganda machines to silence an opposing voice.

I believe is always better having a big state with big presence in the media panorama than a small presence with a lot of private media missinforming and guided only by their will of money.
Now, this country is very corrupt and you will always have mafias, in both sides, government and private, but as I said the ownership of the government channels is for the people, the State, and we can change that with the vote. We watch what we have voted for, I know its propaganda and all that things I dont like, but I prefer that in the hands of the people we have chosen that in private hands only guided by the ambition of gain, deposing governments or even making some people president as it happens in Mexico with Televisa & Peña Nieto.
The media is currently a big place where lots of important political actors converge. It congregates them in a temporary alliance. Economically, politically, it is as important as entire countries with their resources and all. As it were the militars in the past, the institution that concentrates the power of the right is now the media.

So all the people who didn't vote for the govt just lose their freedom to chose their media content?

Scary. Sounds fairly totalitarian and undemocratic to me. What happened to protecting the minority?

Ah now you're making up contentions for me ; )

My contention is that choice is between

1. Monopoly plus govt propaganda - No thanks

2. Govt propaganda + clientele capitalism partner - No thanks

3. Govt propaganda plus independent media not including Clarin - Yay

This should be possible with the insertion of the appropriate articles in the media law to ensure opposing voices on air today and that balance is possible.

OK this is good, but a couple of points:

First, I for one would be extremely opposed to any law saying that Clarín should not be allowed a voice (#3). My point is that neither they nor any group (inc. the govt) should be allowed a monopoly. If they were to be censored or shut down I would be the first out in the street protesting, as much as I detest their opinions.

Secondly, this law represents a framework for ensuring the diversity you mention in point 3, calling for a public/private mix of ownership. How those licenses are granted, I agree with you, is problematic. Look at the US, which has a regulatory framework that is very favourable to big corporate media, but getting licenses for anti-government voices like RT or Telesur has been nearly impossible (case in point: look how Al-Jazeera took 15 years to get a tiny foothold, and they had to change much of their line of criticism to do so.) The Media Law is a marco legislativo: a framework that will obviously need fine tuning to prevent clientelism, but as a framework I can't think of many ways to improve it.

Supreme Court Judge Carlos Hayt Vote Against , only vote....!! Perhaps he didn't hear well...? born 1918 Yes or Nai..?

People can always choose tv channel from the right when the government is from the left, but not otherwise.
As I said, the media is the corporation where all different powerful actors converge, The campo, the hedge funds, the US embassy, you have the Fox news as an example. You will always have a representation in the TV from the right. Always.

But in the case you wont, yes is an abuse of the majority. Thats democracy, an abuse to the minorities. As Borges said, "La democracia es un abuso de la estadistica". its not perfect and you will always find people angry; the governments go in one direction and it do not govern for everybody (in the sense of having everybody content, you go in that direction, and the oposite direction followers will be upset with you. The thing is that is the best system, to me, and you will always have minorities who not vote for you.
