When a company is in bunckrupsy there is always a negociation and creditors have 2 options: to get less or nothing.

On the other hand, there are contracts where the risk (alea) determinantes the price/cost/profit. The higher the risk the bigger is the profit. This is how bonds works.

But the risk might happend and in fact happend.

Yes but Argentina is NOT bankrupt. The holdouts did not accept Argentina's offer years ago. Now the US courts that have legal jurisdiction have said that Argentina is in contempt for not paying. The holdouts or their successors were willing to hang in for over a decade and this is the outcome.
 
What evidence is there that the judge is "senile"? I really find all the negative comments here about age to be offensive. I know a number of people who are in their eighties who are mentally competent - some are still working, albeit at reduced schedules, and performing very well. Even the youth orientated entertainment industry has many actors in their eighties still working. I saw Lauren Becall on stage in New York a few years ago. She was in her 80's, looked great and performed beautifully. Same for Judy Dench. Saw her perform on the London stage a little over a year ago. She must be in her 70's. She has some vision problems but you'd never know it from her acting. WHY does old age = incompetence and senility in the inds of some people on this forum? People are increasingly living longer, many in good physical and mental health. I don't think anyone here would criticize someone because of his race or sexual orientation. WHY should they get away with using age as a weapon? Frankly, there is good reason to think that poster boy Axel and his wacky economic policies may be more senile than Griesa.

Evidence is in the discussion that took place a few months ago, where Griesa admits he has overlooked a few things, said "but Argentina did pay": when reading the transcript (I did fully, but quickly), many times the person asking a question to Griesa has to repeat the question 5 to 7 times (really), and everytime Griesa answers "sorry, I don't understand what you mean" (or sort of).

I'm sure I'll be in worst shape than Griesa at his age (if I reach it), getting old is sad and is not a subject for fun, but Griesa sincerely looks like he needs to retire.

I would like to see the transcript -- hearing it would be better to see if there was a lot of noise in the room, people interrupting the conversation etc before I make a pronouncement of "senile". I am not convinced that there is any proof that this is the case. Be that as it may, Argentina agreed to place itself under the jurisdiction of US courts so as to attract foreign investors. Now the Kirchner government is seeking ways of avoiding that reality. An op-ed piece in today's Wall Street Journal concludes with the following. The key line is the last one:



"This demagoguery may help Mrs. Kirchner's Peronist party in next year's elections. Or maybe not. Argentines now live with an inflation rate estimated at 40%, frequent power outages, plummeting asset values and a toxic reputation in global financial markets. Blaming foreigners for their economic plight is traditional sport for Buenos Aires politicians. But the people of Argentina may eventually figure out that the contempt Mrs. Kirchner and her populist ministers are showering on "the vultures" is ultimately directed at them".
 
Why, because he's old and looks old. Don't be fooled like the idiots from Argentina that mocked him. He's scary lucid. Have a conversation with this guy and and you'll think he's 35. He knows the shit blows up in Jan and RUFO is off the table. The stupids here are the Argentina stupids that continue to dig in deeper and deeper until RUFO gone means nothing.
I've searched for any conversations/interviews with Griesa with no luck.

How badly out of touch are the WSJ. Rabble rousing & innuendo.

I.e, don't feel bad, they're getting what they deserve.

Current approval rating 27%, 58% of people actively want FpV to lose the election.

Griesa's state of mind it's completely academic, more tragic is the buying and selling of political influence to the highest bidder.
