Xmas Rental Nightmare - Advice Please - Where To From Here ?

What about changing the locks, squatting in the flat, and telling them to go to hell? I thought you wanted to be a real Argentine!!
 
Can someone with experience of the law please confirm if the owner is required to give notice of contract renewal before the current contract is complete (60 days ???) We are coming to the end of our 2 year lease and need to know if the owner wants to renew the contract for another two years so we can organize alternative accommodation if necessary. The inmobiliaria is saying there is no law that says they have to give us notice - surely there is something to protect the renter?

If the landlord refuses to renew you can stay until you find an alternate place to live specially if you have children under 18. The Court will allow you. Ask your landlord for a written notice to vacate the premises, In case of a disagreement on the terms or extension you can continue to pay the current rent to a Banco Nacion Entity?( forgot the name) if landlord refuses to receive the payment. Sit put and tell the landlord to initiate eviction process, Desalojo, he knows it will take months to get a Court order to vacate...!! he may not win.

It looks like there is going to be a decent solution to this situation now guys - thought I should update you all. Looks like I will get 1.5 months rent back in the next few days from the landlady (I think she is getting a bit nervous - can't imagine why lol) and it looks like we will have a new apartment in the next few days - still two bedrooms - back to Belgrano though (even though I would have preferred Recoleta) I like both - its actually cheaper (only 6000 pesos per month), sin garantia, no problem with a clause in the contract to say we can renew for up to a minimum of 2 years - OUR choice - still 6 months at a time but basically with the conditions of a long term rental - the place is fully furnished and is NOT right on avenida cabildo (couldn't handle that again) but what can I say? Long term, 6000 pesos a month, sin garantia, furnished, can stay as long as we like - its looking good so far. NOT looking forward to the packing and the moving - but at least things are now starting to look up...
 
How is the clause worded? I would check to be sure that you can't be kicked out again due to this 6 month rental- was there a reason you didn't want to go with the 2 year contract? What happens if someone puts an offer on the apartment and is willing to pay more than you? Just be safe so you don't get stuck in a bad situation again! Good luck with your move!! :)

im assuming he doesnt have a garantia. hence the 6 month contracts. i think if its written into the contract, he has a better chance of the owner keep their word this time. good luck
 
Thanks for that - its STILL not 100% finished - there are some issues with the new apartment and we are still not signed off - so, fingers crossed and we still have several more apartments to see tomorrow - we are cutting it fine - too fine - but then again, not a situation we asked for or created - lets hope its all over/finished tomorrow...
 
PS My partner has two garantias - but they are in provincia so she can't use them - she also has one here in capital and the lady is extremely wealthy - but for some weird reason I don't understand her garantia is also not accepted - its quite beyond me - but bottom line, to all intents and purposes we are sin garantia... That is why we are going through this hell now apparently...
