Benefits Of Argentine Citizenship Vs. Permanent Residency

Ok just met with my immigration lawyer and clarified the answer. For residency purposes once you've gotten your PERMANRNT DNI you are NOT required to spend any particular amount of time in Argentina. They CANT REVOKE IT BECAUSE YOUVE BEEN GONE. However if you are in the country six months of the year you are obligated to pay taxes here. I only asked if there was a requirement to be here OR come back every so often to keep it and they said NO
 
La Coqueta's lawyer may be better than the one I consulted. But the one I asked last January told me that to maintain my residency for my DNI to remain valid, I need to be in Argentina 1 day every 2 years. The rules for tax residency are different.
 
Argentine immigration law, Ley 25.871, clearly states that if you have permanent residency, if you leave Argentina for 2 years without return, your permanent residency will be revoked.

This may be another one of those cases like the 'permatourist' who re-enters the country every 3 months via Uruguay for years, which is completely contradictory to the law which states that as a tourist you are only allowed to be in Argentina a total of 6 months per year and not enforced. However I wouldn't want to count on being a permanent resident, go away for a few years, then come back to find out my residency / DNI / CUIT have been canceled.

With the new DNI, they expires, the problems is going to rise when you want to renew it or if you loose it and you want to apply for a new one.

[background=rgb(179, 217, 226)]c) El beneficiario de una radicación permanente hubiese permanecido fuera del Territorio Nacional por un período superior a los dos (2) años o la mitad del plazo acordado, si se tratara de residencia temporaria, excepto que la ausencia obedeciere al ejercicio de una función pública argentina o se hubiese generado en razón de actividades, estudios o investigaciones que a juicio de la Dirección Nacional de Migraciones pudieran ser de interés o beneficiosa para la República Argentina o que mediara autorización expresa de la autoridad migratoria la que podrá ser solicitada por intermedio de las autoridades consulares argentinas.[/background]
 
That's not the case as far as I know now. You have to return to Argentina every 3 years (although someone posted recently it's every year) in order to retain your permanent residency. I'll try and dig up the info.

EVERY TWO YEARS - unless the law has changed in recent months. Be careful that your lawyer is actually an IMMIGRATION specialist. Many lawyers are willing to do all sorts of law that they may not know much about.

But what is the problem other than having to come back to Argentina to renew/replace the DNI? I don't see the big issue other than the obvious one of having to return.

I agree. My DNI expires in 2028. So renewing prior to that doesn't seem to be a very high bar. Seems despite the law--this will remain ambiguous or unevenly applied.
